If your financial situation has significantly changed since the order was issued, you have the legal right to request a reduction. You must file with the court — the change is NOT automatic.
If you're the receiving parent and the paying parent's income has increased — or your child's needs have grown — you can request an increase.
Gather: pay stubs, tax returns (2 years), termination letter if laid off, bank statements, medical records if applicable.
Use our Calculator tab or your state's online child support estimator. Know your number before you file.
Option A: File through your state's child support agency (free, slower). Option B: File a Motion to Modify with the family court directly (faster, small fee).
They must be legally notified. Certified mail or process server. Keep your proof of service.
Bring all documentation. Dress professionally. Speak facts, not feelings. Present your financial evidence clearly.
Once approved, a new income withholding order is issued. Keep a copy. Update any automatic payment records.
Child support does NOT stop automatically in most states. You must take action to officially terminate it — or risk continued wage garnishment even after eligibility ends.
• California: 18 (or 19 if still in high school)
• Texas: 18 or high school graduation, whichever is later
• Florida: 18 (or up to 19 if still enrolled in high school)
• New York: 21 years old — longer than most states!
• Pennsylvania: 18 (or high school graduation)
• Minnesota: 18 (or 20 if still in secondary school)
Action Required: File a Motion to Terminate with the court. Do not simply stop paying without a court order.
• Child gets married
• Child joins the military
• Child becomes financially self-supporting (court-approved)
• Court grants emancipation petition
Action Required: Present emancipation documentation to the court and file to terminate the support order.
1. Document the change in living arrangement
2. File a Motion to Modify or Terminate based on custody change
3. Get a new court order — informal arrangements are NOT enforceable
Evidence needed: School enrollment records, doctor's address, utility bills showing child's residence.
• You may petition for termination and relief of arrears
• This varies SIGNIFICANTLY by state — some states have strict time limits (e.g. TX: must file within 4 years of birth certificate or order)

• Death of the paying parent: obligation may pass to the estate
• Death of the receiving parent: support continues but may be redirected to child's guardian or custodian
Always notify the court immediately upon any death and file to update or terminate the order.
Child turned 18/21? Emancipated? Moved in with you? Paternity disproven? Document everything.
Even if support terminates, any unpaid arrears survive. You must pay what you owe even after termination.
Use the Letters tab to generate your termination request. File with your county family court.
Once the court issues a termination order, take it to your HR/payroll department to stop wage withholding.
If the paying parent has stopped paying or is behind on support, you have powerful legal tools available — most at no cost through your state agency.
How to request it:
1. Contact your state child support agency
2. File a Request for Income Withholding Order with the court
3. Employer receives the order and must comply within days
Federal law: All child support orders must include an automatic income withholding provision (42 U.S.C. §666).
Process:
1. Obtain a judgment for the arrears amount
2. File a Writ of Execution with the court
3. Serve the bank — they freeze and transfer funds
Best for self-employed obligors without regular wages.
Covers: Driver's license, contractor's license, real estate license, nursing license, passport
How to trigger it: File a report with your state child support agency. They handle the rest — it's free.
Warning to paying parents: Don't ignore arrears. One delinquency notice can result in license suspension within 30-60 days.
Federal: IRS intercepts if arrears exceed $500 (or $150 if the child is on public assistance)
State: All 6 covered states participate in state tax intercept programs
This happens automatically once reported through your state agency — no separate court action needed.
Consequences can include:
• Fines
• Community service
• Jail time (last resort, but real)
• Attorney fee awards to you
Use the Letters tab to generate a Contempt Motion template.
Effect: The paying parent cannot sell or refinance property without first satisfying the child support lien.
Action needed: In some states, you must file the lien with the county recorder's office. Check your state's rules in the States tab.
