🛑 Termination Guide

Child support does NOT stop automatically in most states. You must take action to officially terminate it — or risk continued wage garnishment even after eligibility ends.

Warning: Even after a child turns 18, some income withholding orders continue until YOU file to stop them. Check your state's rules below.
✅ Legal Grounds to End Support
🎂 Child Reaches Age of Majority
State-by-State Ages:

California: 18 (or 19 if still in high school)
Texas: 18 or high school graduation, whichever is later
Florida: 18 (or up to 19 if still enrolled in high school)
New York: 21 years old — longer than most states!
Pennsylvania: 18 (or high school graduation)
Minnesota: 18 (or 20 if still in secondary school)

Action Required: File a Motion to Terminate with the court. Do not simply stop paying without a court order.
🎓 Child Is Emancipated
Emancipation can occur before 18 if:

• Child gets married
• Child joins the military
• Child becomes financially self-supporting (court-approved)
• Court grants emancipation petition

Action Required: Present emancipation documentation to the court and file to terminate the support order.
🏠 Child Moves In With You Full-Time
If the child's primary residence switches to you, support may be reduced or terminated — but you must:

1. Document the change in living arrangement
2. File a Motion to Modify or Terminate based on custody change
3. Get a new court order — informal arrangements are NOT enforceable

Evidence needed: School enrollment records, doctor's address, utility bills showing child's residence.
🧬 Paternity Fraud / DNA Disproof
If DNA evidence proves you are NOT the biological father:

• You may petition for termination and relief of arrears
• This varies SIGNIFICANTLY by state — some states have strict time limits (e.g. TX: must file within 4 years of birth certificate or order)
• CA is more flexible if fraud can be proven
• NY courts have ruled both ways — get legal help immediately

💼 Wage Garnishment (Income Withholding)
The most powerful tool. The court orders the paying parent's employer to automatically deduct support from their paycheck before they ever see it.

How to request it:
1. Contact your state child support agency
2. File a Request for Income Withholding Order with the court
3. Employer receives the order and must comply within days

Federal law: All child support orders must include an automatic income withholding provision (42 U.S.C. §666).
🏦 Bank Account Levy
Courts can seize funds directly from the paying parent's bank account to cover arrears.

Process:
1. Obtain a judgment for the arrears amount
2. File a Writ of Execution with the court
3. Serve the bank — they freeze and transfer funds

Best for self-employed obligors without regular wages.
🚗 License Suspension
States can suspend driver's licenses, professional licenses, and even passports for chronic non-payment.

How to trigger it: File a report with your state child support agency. They handle the rest — it's free.

Warning to paying parents: Don't ignore arrears. One delinquency notice can result in license suspension within 30-60 days.

Federal: IRS intercepts if arrears exceed $500 (or $150 if the child is on public assistance)
State: All 6 covered states participate in state tax intercept programs

This happens automatically once reported through your state agency — no separate court action needed.
⚖️ Contempt of Court
If all other methods fail, you can file a Motion for Contempt. The paying parent must appear before a judge and explain why they haven't paid.

Consequences can include:

In most states, a child support judgment automatically creates a lien on any real property owned by the paying parent.

Effect: The paying parent cannot sell or refinance property without first satisfying the child support lien.

Action needed: In some states, you must file the lien with the county recorder's office. Check your state's rules in the States tab.
